Da análise da jurisprudência do Tribunal Internacional de Justiça e dos tribunais regionais dos direitos humanos europeu, interamericano e africano sob o prisma da consagração da noção de jus cogens, surge um diálogo amplamente moribundo entre os juízes. Uma consagração prudente e totalmente autocentrada pelo juiz internacional opõe-se a uma consagração contrastada e amplamente autocentrada pelos juízes regionais.
